1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Gethsemane mobile application ("App"), operated by GGWP Group Ltd., a company registered under the laws of Finland, with its registered office at Ruskontie 6 D 22, 33710 Tampere, Finland ("Company", "we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you and the Company. Please read them carefully before using the App.

2. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the App with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the App, you represent and warrant that you meet these eligibility requirements. We do not knowingly collect personal data from children under the age of 13. If we become aware that a user is under 13, we will take steps to delete their account and associated data.

3. Account Registration and Anonymous Use

The App allows you to begin using the service without creating a traditional account. Upon first use, an anonymous account is automatically created for you. You may optionally link your account to a Google or Apple sign-in to enable cross-device subscription synchronisation.

You are responsible for maintaining the security of your device and any credentials associated with your account. You must not share your account credentials with any third party.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Description of the Service

Gethsemane is a personal mood and journal tracking application with a Christian spiritual focus. The App provides the following features:

  • Personal journal entries for recording thoughts and reflections
  • AI-generated mood analysis, including mood colour categorisation and automatic tagging
  • AI-generated Bible verse recommendations, personalised explanations, and prayers based on your journal entries
  • AI-generated song and reading recommendations
  • Contribution graphs and mood insights over time
  • Data export and import functionality using encrypted database files
  • Optional biometric app lock (Face ID, fingerprint, or device PIN)
  • Multi-language support (English, Spanish, Italian, French, Portuguese)
  • Light, dark, and system theme options

Journal entries are stored locally on your device in an encrypted SQLite database (SQLCipher). Your journal content is never synced to our cloud servers, although it is transmitted to our servers for AI processing when you create an entry.

5. Subscriptions and Payments

5.1 Free Trial

The App offers a 7-day free trial that provides full access to all premium features. The free trial is limited to one trial per device. Eligibility for the free trial is determined by your device identifier and cannot be reset by reinstalling the App or creating a new account.

5.2 Subscription Plans

After the free trial expires, continued access to premium features requires an active subscription. The following subscription plans are available:

  • Weekly: €2 / $2 per week
  • Monthly: €7 / $7 per month
  • Annual: €70 / $70 per year

Prices may vary by region and are displayed in your local currency in the App. Actual pricing is determined by the Apple App Store or Google Play Store.

5.3 Auto-Renewal

All subscriptions are auto-renewing. Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

5.4 Managing and Cancelling Subscriptions

Subscriptions are managed through the Apple App Store or Google Play Store. To cancel your subscription:

  • iOS: Go to Settings > [your name] > Subscriptions, select Gethsemane, and tap Cancel Subscription.
  • Android: Go to Google Play Store > Menu > Subscriptions, select Gethsemane, and tap Cancel.
  • In-App: Use the "Manage Subscription" option in the App's settings to access the subscription management interface.

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period for which you have already paid. No refunds are provided for partial billing periods.

5.5 Refunds

Refund requests must be directed to Apple or Google, as all payments are processed through their respective platforms. We do not process payments directly and cannot issue refunds. Refund eligibility is subject to Apple's and Google's respective refund policies.

6. AI-Generated Content

The App uses artificial intelligence to generate content, including but not limited to Bible verse recommendations, personalised explanations, prayers, mood analysis, tags, and song and reading recommendations. This content is produced by third-party AI models and is provided for informational and inspirational purposes only.

Important disclaimers regarding AI-generated content:

  • AI-generated content is not a substitute for professional mental health advice, counselling, therapy, or medical treatment. If you are experiencing a mental health crisis, please contact a qualified healthcare professional or emergency services immediately.
  • AI-generated spiritual content (Bible verses, prayers, explanations) is not a substitute for personal pastoral guidance, professional theological counsel, or the advice of a qualified religious leader. The App is a devotional aid, not a replacement for community worship or spiritual direction.
  • AI-generated content may contain inaccuracies, misinterpretations, or errors. We do not guarantee the theological accuracy, completeness, or appropriateness of any AI-generated content.
  • Song and reading recommendations are generated by AI and may not always be suitable for your preferences or circumstances.

By using the App, you acknowledge and accept these limitations. We disclaim all liability arising from your reliance on AI-generated content.

7. User Content

"User Content" refers to any text you enter into the App, including journal entries. You retain full ownership of your User Content.

By using the App, you grant us a limited, non-exclusive, non-transferable licence to process your User Content solely for the purpose of providing the App's features, including transmitting your journal entries to our AI processing servers to generate mood analysis, Bible verses, prayers, tags, and recommendations. Your User Content is not stored on our servers after processing is complete.

You are solely responsible for the content of your journal entries. You agree not to use the App to create, store, or transmit content that:

  • Is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Infringes on the intellectual property rights of any third party
  • Contains malicious code, prompt injection attempts, or content designed to manipulate or exploit the AI systems
  • Violates any applicable law or regulation

We reserve the right to implement automated safeguards, including prompt injection detection, to protect the integrity of our AI systems. Attempts to manipulate or circumvent these safeguards may result in temporary or permanent suspension of your access to the App.

8. Intellectual Property

The App, including its design, code, graphics, logos, fonts, user interface, and all related intellectual property, is owned by or licensed to the Company and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the App or any part thereof.

9. Data Security

We take the security of your data seriously. Your journal entries are stored locally on your device in an encrypted database using SQLCipher (AES-256 encryption). Sensitive credentials are stored using your device's secure storage (Keychain on iOS, Keystore on Android).

You are responsible for safeguarding your database encryption key. If you export your data, the exported file is encrypted and can only be imported using the correct encryption key. We do not have access to your encryption key and cannot recover your data if the key is lost.

All communications between the App and our servers are encrypted using HTTPS/TLS. Despite these measures, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from:

  • Your use of or inability to use the App
  • Any AI-generated content provided through the App
  • Unauthorised access to or alteration of your data
  • Loss of your database encryption key
  • Service interruptions, errors, or downtime
  • Any conduct or content of any third party in connection with the App

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In jurisdictions that do not allow the exclusion or limitation of certain warranties or liabilities, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

11. Termination and Account Deletion

You may stop using the App at any time by uninstalling it from your device. You may also delete your account through the App's settings, which will:

  • Permanently delete your account information from our servers
  • Delete all locally stored journal entries, tags, and data from your device
  • Remove your session data and authentication tokens
  • Log you out of any connected subscription services

Account deletion is irreversible. We recommend exporting your data before deleting your account if you wish to retain a copy of your journal entries.

Account deletion does not automatically cancel any active subscription. You must cancel your subscription separately through the Apple App Store or Google Play Store to avoid continued charges.

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

12. Third-Party Services

The App integrates with third-party services to provide its functionality. These include:

  • Apple App Store / Google Play Store: For app distribution, subscriptions, and payment processing
  • RevenueCat: For subscription management and entitlement verification
  • Cloudflare: For backend infrastructure, including API hosting, data storage, and security
  • Replicate: For AI model processing of journal entries
  • PostHog: For anonymised product analytics
  • Google / Apple Sign-In: For optional account linking via OAuth

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

13. Apple App Store and Google Play Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and the Company, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • The licence granted to you is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for any claims by you or any third party relating to your use of the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

If you downloaded the App from the Google Play Store, the following additional terms apply:

  • These Terms are between you and the Company, not Google LLC ("Google"). Google is not responsible for the App or its content.
  • Your use of the App is also subject to the Google Play Terms of Service.
  • Google is not responsible for any claims relating to the App, including product liability, consumer protection, or intellectual property claims.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your User Content caused damage to a third party.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by providing notice through the App.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and delete your account.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Tampere, Finland.

If you are a consumer residing in the European Union, you are entitled to invoke any mandatory consumer protection provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU or national law. You may also make use of the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the App and supersede all prior agreements, representations, and understandings.
